Use of the Platform
The use of the Platform attributes the status of User and implies full acceptance by the User of all the Conditions of Use of the Platform in force when he or she accesses it. Consequently, if the User does not agree with any of the conditions laid down herein, he/she should not use this Platform.
In like manner, the User undertakes not to use the tool for illegal purposes or effects, contrary to the contents of this legal notice, that might injure the rights or interests of third parties, or which may in any way damage, render useless, overload, deteriorate the Platform or contents provided in it or impede the normal use or enjoyment of the Platform by other users.
The User shall refrain from obtaining information, messages, graphics, drawings, sound and/or image files, photographs, software and, in general, any class of accessible material through the Platform or its services, using means other than those that have been made available to it, or, in general, those that are regularly used on the Internet.
Right to modify the Platform, right to restrict access to the Platform and right to suspend its operability
Codemotion reserves the right to modify the presentation or configuration of the Platform at any time, without prior notice, and the information, services, the present Conditions of Use of the Platform, or any other applicable general or specific conditions, instructions, or notices. In addition, Codemotion reserves the right to suspend, interrupt or leave the Platform inoperative, or to restrict its access, partly or completely, individually or collectively, temporarily or finally, at any time.
Intellectual and industrial property rights
All text, images, audio, video, scripts, code, software, databases and any other form of information on the web site, unless specifically labelled otherwise, belongs to or has been licensed by Codemotion.
The User grants Codemotion a licence (including intellectual property rights) to the materials and content which the User posts on the Platform (“User Generated Content” or “UGC”). This licence is intended to be non-exclusive, indefinite and not revocable except if there is a risk of serious damage to the image and/or decorum of the User. The Contents generated by the User may be used for the purpose of dissemination on online communication channels (e.g. social networks) as well as possible subsequent publication in the press, distribution and broadcasting through any means of communication to the public.
Users undertake to only publish content on the Platform for which they own or for which they have the relevant rights of use and licences, refraining from publishing material that may violate intellectual and industrial property rights and any other rights of third parties. To this end, Users hereby agree to indemnify and hold Codemotion harmless from any prejudice, damage, and consequence, direct or indirect, which Codemotion may incur as a result of the publication on the Platform of a UGC by Users.
Codemotion is not responsible for the content of any other website, including any website through which you may have gained access to the Platform or to which you may gain access from the Platform. Codemotion does not accept any liability in connection with any such sites or links.
Exclusion of guarantees and responsibility
Codemotion do not guarantee the availability and continuity of the functioning of the Platform and shall in no event be held liable for damages or losses that might be derived from (i) lack of availability or accessibility to the Platform or those other sites with which a Link has been established; (ii) interruption in the functioning of the Platform or computer faults, telephone failures, disconnections, delays or blocking caused by deficiencies or overloads on the telephone lines, in the Internet system or in other electronic systems produced in the course of its functioning; (iii) lack of suitability of the Platform for the specific needs of the Users and (iv) other damages that might be caused by third parties through unauthorised intromissions or hackers outside the control of Codemotion.
Codemotion adopts various protection measures to protect the Platforms and contents against hackers. However, this does not guarantee the unauthorised use by third parties to access the type of use of the Platform made by the User or conditions, characteristics, and circumstances in which that use is made. Codemotion shall consequently in no event be responsible for damages or losses derived from such unauthorised access.
Codemotion shall in no event be responsible for the use that users and/or third parties may make of the tool, or for any damages arising therefrom.
The Contents of the Platform are the sole property of the Codemotion and are made available by it in good faith and with the best professional quality standards. Codemotion however excludes any kind of liability for damage of any nature that might be due to lack of truthfulness, accuracy and/or current importance of the contents of the Platform.
Codemotion, prior to the publication on the Platform of a content by Users, cannot carry out a preliminary verification of the correctness of the textual content and, for this reason, is not responsible for such content. However, Codemotion reserves, at its sole discretion, the right to remove content which is in conflict with this legal notice or which may violate the rights of other Users or third parties.
By way of example only, Codemotion points out that Content is not permitted that:
- violate intellectual property rights and any other industrial property rights
- incite violence, discrimination, racism or intolerance
- violate the right to confidentiality of other Users or third parties;
- constitute and/or encourage boycott campaigns against products or services;
- defame third parties or other Users
- have vulgar or obscene content.

Exclusion of Commission responsibility
Any communication or publication on the Platform made by Codemotion in any form and using any means, must indicate:
(a) that it reflects only the author’s view; and
(b) that the Commission is not responsible for any use that may be made of the information it contains.
